Jim Mc Manus, Spillane’s uncle and a long-time neighborhood broker narrates that Spillane, who had one arm on a sling leaned on the screen of an open window when he lost his balance, tumbled and fell. He was calling out to his brother Michael, who was on the street.

New York Police has not confirmed whether Spillane fell through a window after a screen collapsed but they definitely ruled out any signs of foul play. Medics responded to the accident scene when they received a call that was made on Eighth Avenue at about seven forty-five. Spillane was pronounced dead on the scene.

Spillane was described by his uncle as the nicest kid in the world who was always ready to help anyone. One detective described him in an article that appeared in New York Times, as a very strong enforcer, a handsome, black-haired tough guy out of the movies.
