We cannot deny the fact that Apple is one of the most sought-after brands when it comes to gadgets like mobile phones, tablets and computers. As a matter of fact, Apple has greatly influence a lot of consumer products as far as design is concerned. However, this great influence that Apple has is also the root cause of a recent lawsuit filed against one of the biggest gadget manufacturers in the industry – Samsung. Apparently, Apple has sued Samsung Electronics for allegedly copying the look and feel of its iPad tablet and iPhone smartphone.
In this lawsuit, Apple has singled out the Samsung Galaxy Tab, Epic 4G and Nexus S as the infringing products that apparently copy Apple’s technology, user interface and its innovative style instead of developing their own technology and style. Apple also claims that the arrangement of icons and packaging are similar between the Galaxy phones and the iPhone.
In addition to this, Apple has also stated that the Samsung Galaxy Tab also copied several elements of the Apple Product Configuration Trade Dress and also includes its rectangular design with rounded corners. This only indicates that other tablet manufacturers such as Motorola and HTC can also expect some lawsuits in the future too.
This lawsuit is not really new at all as Apple has also involved in several lawsuits with Nokia and HTC for allegedly infringing upon iPhone patents. However, just recently the US International Trade Commission has stated that both companies are not found liable.
The said lawsuit was filed by Apple against Samsung in the Northern District of California with the purpose of seeking injunction against Samsung Electronics. However, others view it as some sort of cold war between Apple and Google since most of Samsung’s devices are running the Android OS. Of course, it is a known fact that the Apple’s iOS and Google’s Android are tough competitors in the industry.
As far as Apple is concerned, it is only their right to protect Apple’s intellectual property from those companies who intend to steal their ideas. And it looks like Apple may ask the courts to pull out the Samsung products involved in this lawsuit from the market.
Apparently, Samsung will be taking some counter action against Apple for allegedly accusing them of copying its smartphones and tablets through appropriate legal measures. Samsung’s officials claimed that they have been successfully developing their own core technology and intellectual property portfolio.
Well, patent lawsuits are normal occurrences among technology giants in the US. So let us just wait and see what will happen in this case.
