When you promise customers something and don’t keep it for a long time, expect them to be furious…and to be filed a lawsuit.
This is what happened with T-Mobile and Samsung as they are facing a class action lawsuit against them by a XDA Developers forum member named MicBeast. The reason for this is that the Samsung Vibrant, the Galaxy S variant that introduced on T-Mobile networks in 2010, have not received any updates to Android 2.2 and still has the old OS until now. Before going to the details of the lawsuit, let’s go back to the origins of why the lawsuit even came about.

An unnamed source started a rumor where Samsung (but not T-Mobile) was holding back the updates of Android 2.2 on purpose because manufacturers wanted to make sure that customers will buy their upcoming new devices.
And because of this, a lot of people complained and MicBeast decided to do some action by doing the right procedure in filing a lawsuit: found some lawyers who ca take up the case, filed the lawsuit, explained the issues, and then the lawyers agreeing that they have a strong case. They said that the two companies have violated the law, which is the Unfair and Deceptive Consumer Business practices.
According to the lawyers, Samsung and T-Mobile have continuously lied about the hardware and software of the phone and that the device is clearly a hardware defect. They promised a lot of times that the Samsung Vibrant will be updated, but it never happened. And now they are releasing new devices without even updating the old ones. And not only did they not update to Android 2.2 and has remained the J16 2.1, but they also failed to update the 4G speeds.
The bad thing about this is that whenever the customers complained, the customer service representatives have been very combative about it, to the point that they even bullied and threatened the customers. MicBeast encourages the customer to email him on his email and support the lawsuit.
If this is true, then the two companies are in big trouble. The last thing that a company should do is not keep promises that you have been promising your customers for a long time and then suddenly coming up with new products without even considering their requests.
